Terms and Conditions

iOneFour Ltd, specialist suppliers of high quality Litho and digital print to the trade.

The following terms and conditions apply to all between relationships between you, the client, and ourselves, iOneFour Ltd, or www.ionefour.co.uk. By commissioning us to work on a project, you are agreeing to these terms in connection with our design and associated services.

In these terms and conditions “iOneFour Ltd” means the company supplying the goods and “Customer” means the person or Company that purchases the goods specified in the “iOneFour Ltd” invoice.

iOneFour Ltd Conditions of Sale Apply

These Terms & Conditions of Sale shall apply to and govern any contract between iOneFour Ltd and the customer to the exclusion of any conditions contained on or in any order form letter, receipt, acknowledgement, or any other document emenating from the Customer and no variation of these terms & Conditions shall be effective unless expressly agreed by iOneFour Ltd in writing.

Orders

All orders by the Customer must be submitted in writing via fax, email or post. Verbal orders will not be processed.

Prices

All prices quoted are subject to confirmation. All quotes given verbally or in writing are subject to change on sight of the Customers artwork.

Credit Accounts

Credit Accounts with agreed limits may be given to approved accounts at the sole discretion of iOneFour Ltd, who may require both bank and trade references. All invoices must be paid within 30 days. All payments which are not received when payable shall be considered overdue and iOneFour Ltd reserves the right to cancel or amend a credit limit previously granted.

Dispatch and delivery

Delivery periods serve as an indication of the delivery date only and are only subject to a strict deadline iOneFour Ltd is not responsible for 3rd party delivery service and their terms.

iOneFour Ltd shall make every effort to prevent production problems causing a delay in the delivery. iOneFour Ltd cannot be held liable for consequential damage and losses caused by delays in dispatch and delivery. iOneFour Ltd cannot be held liable for delays in the delivery caused by adverse weather conditions, delays at shipping companies, customs issues or other circumstances beyond the control of iOneFour Ltd. Dispatch and delivery periods are set by iOneFour Ltd on the basis of information obtained from our suppliers.

iOneFour Ltd shall make every effort to honour the promised delivery period. The printing process can nevertheless be delayed due to sudden equipment failures, breakdowns and/or technical problems. In the event of a delay due to a technical breakdown, additional costs for urgent jobs shall be refunded or waived, if applicable.

The dispatch costs are calculated on the basis of a single shipment to the address as indicated by the client.

Dispatch costs for high volumes of products are available on request.

Claims

Claims arising from damage to, or partial loss of goods in transit must be made in writing to iOneFour Ltd and the carrier so as to reach them within three days of delivery and claims for non-delivery within 28 days of dispatch of the goods. iOneFour Ltd requires all customers to sign for their goods unchecked upon receipt.

Quality Assurance

Goods supplied by iOneFour Ltd failing to equal the specifications as stipulated will be replaced or a refund of the purchase price will be made at the discretion of iOneFour Ltd subject to the following:

  • The goods must be returned to iOneFour Ltd by the Customer.
  • No refund will under any circumstances exceed the purchase price paid for such goods by the customer to iOneFour Ltd.
  • All goods must be inspected on receipt and any mistakes or damage reported to iOneFour Ltd within 5 working days.
  • iOneFour Ltd will not accept liability after this time.

Contract

The contract between iOneFour Ltd and the customer shall be governed by and construed in accordance with the jurisdiction of residence of iOneFour Ltd

Our right to sub-contract

We are entitled to sub-contract any of the work to be carried out on your project.

Force Majeure

Every effort will be made to carry out the contract but due to its performance is subject to cancellation by iOneFour Ltd or to such variation as it may find necessary as a result of inability to secure labour, materials or supplies or as a result of any Act of God, War, Strike, Lockout or other labour dispute, Fire, Flood, legislation or other cause (whether of the foregoing class or not) beyond iOneFour Ltd’s control.

Terms & Conditions

The failure of iOneFour Ltd at any time of any period to enforce any one or more of these Terms and Conditions shall not be a waiver of the right to enforce such Terms and Conditions on a future occasion.

Each of the above conditions shall be read and construed independently of each other so that if one or more is held to be invalid as an unreasonable restraint of trade or for any other reason whatsoever, then the remaining Terms & Conditions shall be valid to the extent they are not held to be so invalid. Further, in the event that any Terms and Conditions shall be found to be void but will be valid if some part thereof were deleted then such term and conditions shall apply with such modification as may be necessary to make it valid and effective.

Your use of this Web site and downloads from it, and these terms of use, shall be governed by the laws of England. The English courts shall have exclusive jurisdiction over any dispute arising out of your use or non use of this Web site.
